Powermedica Defendants Sentenced to Prison

The principals owners and operators of Powermedica have been sentenced to prison after pleading guilty to conspiracy and distribution charges related to the sale of anabolic steroids and human growth hormone. The defendants admitted to selling anabolic steroids and human growth hormone for bodybuilding, performance enhancement and anti-aging purposes.

Daniel L. Dailey, the former Chief Executive Officer of Powermedica, was sentenced to 46 months imprisonment while his father William L. Dailey (former President and Chief Operating Officer) was sentenced to 18 months imprisonment.

The “doctors” responsible for signing the steroid and HGH prescriptions were also sentenced. James D’Amico, a former licensed dentist, and Manuel Sanguily, a license medical doctor, were sentenced to 51 months and 30 months, respectively..

In court documents, the defendants admitted that Powermedica placed advertisements in bodybuilding and fitness magazines, created the internet website, powermedica.com, and used customer handouts to promote the sale and distribution of hGH and anabolic steroids for bodybuilding, athletic performance enhancement, and anti-aging purposes. On the website and in the handouts, Powermedica provided its customers with instructions and directions on how to use hGH and anabolic steroids for athletic performance and anti-aging.

The defendants all admitted that they knew that the hGH and anabolic steroids Powermedica distributed were being used for bodybuilding, athletic performance enhancement, and anti-aging purposes. They also all admitted that they knew that Powermedica’s sales staff, who were not medically trained, were deciding in consultation with the customers which drugs the customers were to receive. In addition, they all admitted that the licensed practitioners, such as Manuel Sanguily and James M. D’amico, were simply signing the prepared drugs orders without meeting with, talking to, or physically examining the customers, and without reviewing the customer’s medical history record and, if obtained, blood test results.

PowerMedica was a Deerfield Beach (Florida) pharmaceutical company raided in 2005 by federal agents for selling mislabelled human growth hormone (hGH) and anabolic steroids without a valid prescription. An undercover investigation by federal agents from the Food and Drug Administration found the company to distribute hGH imported from China as well as anabolic steroids such as stanozolol and nandrolone decanoate.

In 2005, eight Broward sheriff’s deputies were investigated after the U.S. Attorney’s Office in Miami discovered their names in the customer/patient records seized from PowerMedica, a now-defunct Deerfield Beach compounding pharmacy. Federal prosecutors turned over the names of steroid users to the Broward Sheriff’s Office for further investigation.

The PowerMedica patient records contained the names of hundreds, if not thousands, of patients who were prescribed steroids. However, law enforcement employees were the only individual users, aside from famous athletes and entertainers, who were targeted. All eight BSO employees were cleared of wrongdoing in the 2005 case because they had prescriptions for steroids.
