    Dietary supplement manufacturer agrees to $1.75-million fine for false advertising

    A dietary supplement manufacturer agreed Thursday to pay Orange County authorities a $1.75-million fine for violating consumer protection laws by falsely advertising that its product increased penis size.

    Monrovia-based Biotab Neutraceuticals marketed and sold in Orange County a product called ExtenZe, claiming without substantiation that the supplement could increase a man’s penis size, according to a statement from the Orange County district attorney’s office, which brought the case against the company.

    The district attorney had sued the company, and the former owner of ExtenZe, a company called Dish Direct Inc., in 2006 for making the same claims about its product, and won a $300,000 settlement and an agreement with the company to stop falsely advertising the product.

    The office filed the second suit alleging the company had violated that 2006 agreement.

    As part of the agreement signed Thursday, Biotab must follow strict testing procedures for all its products, according to the statement.

    No one was available at Biotab to comment on the case. The company’s limited website, biotab.com, says its makes "all-natural, life-style" supplements, and sells them through national pharmacies, such as CVS, Walgreen’s, Wal-Mart and others.

    The fine against the company will be used to fund further enforcement of California consumer protection laws in Orange County, the statement said.
