Has anyone got an update on the PH Ban?
I know congress passed it, but did the Prez sign it yet?

no.

Posted by: Pirate!

Does he only have until Friday to sign it?

Posted by: Prince

who cares?

if there is going to be a 90 day grace period I guarantee all of the big supplement stores and PH/PS manufacturers will let us all know.

if you purchase from BulkNutrition there is no doubt Mike will have emails sent out as soon as this goes into effect, and I am sure he will also have a countdown on his site just like he did with ephedra.

what happens if he doesnt sign it?

he will.

Posted by: nikegurl

i'm sure he will sign it too....but if he doesn't sign, it will have to start all over again in the next session of congress.

Posted by: G-man

I think he has 10 days to sign it, or the process will have to start over

Posted by: tomas101

today is the 10th day...

I hope companies wont jack up their prices to make some serious cash. If they want to get rid of their stock then lower the prices and give us some deals.

i read that Bush only has to sign it into law before Congress adjourns for the year (which hasn't happened yet).

i'm honestly not sure if that is correct b/c i've also been hearing the "10 day thing"

it's almost inconceivable that anyone will have problems getting rid of their stock. I doubt prices will lower, yet I doubt they will go up either as someone will always be there to undercut anyone who gouges

Matt, who runs customnutritionwarehouse.com, said this today:

UPDATE

An email from the USFA Director....this was news to me as well, and upsetting to say the least.

USFA Update: October 18, 2004

Just so everyone understands that the 10 days has not necessarily begun to run yet...

Mike wrote on 10/18/04:

"Romano... Am I correct in my understanding that the 10 days the President has in which to sign the legislation runs from the date both Houses of Congress have passed the legislation, not counting Sundays? So if the President doesn't sign, then the enactment date would be Wednesday, the 20th? Thanks.

Mike"

Romano wrote on 10/18/04:
"Mike:

Actually, its not quite correct. The ten days starts running after the White House has received the “enrolled” version of the bill. There is no set time for that to happen as long as Congress has not adjourned sine die. For example, the tax bill that just passed will not be sent to the President until after the election for political reasons. I have been trying to find out exactly where 2195 is in the process but so far to no avail. I have a call into the Senate enrolling clerk who hopefully will call me back tomorrow and actually have some information. Biden seems blissfully unaware as well. Romano"

I just saw on AM that it was enrolled to the White House on the 13th and will become law on Oct. 25th unless Bush signs it earlier. The 90-day grace period is in the bill bringing it to January 23rd.

Posted by: Pirate!

Yeah, Matt is good guy for keeping us informed. Thanks rrgg.

If the following looks familiar....it's b/c I cut and pated it from bulknutrition's forums

The ban is not yet law as of 10/19

Both the House and Senate approved the current bill, S.2195

The bill includes a 90-day grace period that begins the day the bill becomes law.

The bill was "enrolled" to the President on 10/13

As of 10/19, the President hasn't signed it into law.

After receiving the bill, the President has 10 days to sign. Apparently this is actual days excluding Sundays

Without a presidential signature, the bill will become law on the 10th day, Monday,
October 25th, and the 90-day grace period would go through January 23rd.

With a presidential signature, the bill could become law earlier than the 25th

In general, if 10 days pass without a presidential signature, a bill automatically becomes law as long as Congress has not already "adjourned."

In general, if 10 days pass without a presidential signature, a bill does NOT become law if Congress has "adjourned." This is also known as a "pocket veto."

There's some confusion about the meaning of "adjourned." Although the House website does say they've adjourned, they haven't adjourned for the year. They will have a lame duck session in December meaning a pocket veto is not possible.

Bush will not veto this bill

Posted by: nikegurl

again from bulk nutrition's forums:

http://en.wikipedia.org/wiki/Pocket_veto

"A pocket veto is a legislative maneuver in American federal lawmaking. The U.S. Constitution requires the President to sign or veto any legislation placed on his desk within ten days (Not including Sundays). If he does not then it becomes law by default. The one exception to this rule is if Congress adjourns before the ten days is up. In such a case the bill does not become law, it is effectively, but not actually, vetoed. Ignoring legislation, or "putting a bill in one's pocket" until Congress adjourns is thus called a pocket veto.

From the U.S. Constitution Article 1, Section 7: "...If any Bill shall not be returned by the President within ten Days (Sundays excepted) after it shall have been presented to him, the Same shall be a Law, in like Manner as if he had signed it, unless the Congress by their Adjournment prevent its Return, in which Case it shall not be a Law. "

*****
bottom line - if Bush does nothing - it will still become law on 10/25. if he signs sooner it will be sooner. it would only be stopped at this point if he vetoes it (and that isn't going to happen)

That's funny. Didn't rrgg post that on BN.com?

Posted by: nikegurl

yep - i should have given him credit and not just the board i got it from (sorry rrgg. i only quoted you b/c it was the best update i've seen in awhile )

Posted by: edudlive

If he doesn't sign it within 10 days it becomes law by default, unless congress' session is up within that 10 days.

Posted by: Prince

does anyone really believe that Bush would let this thing slip?

do you remember when he brought up "steroids" at the State of the Union address:
http://www.sfgate.com/cgi-bin/articl...NGTF4E9HH1.DTL

Posted by: nikegurl

he can't let it slip. if he does nothing - it becomes law. he'd have to veto it to stop it.

Posted by: Prince

good, it should help increase the sales of my product!

See this yet?

I had to shrink it down small to get it to upload.

Underneath, it says "Hey, youve got your priorities, Ive got mine."

Hey, you stole that from my sig line!

Here is a funny blurb going around the net:

In case you never saw this one!.....

Can you imagine working for a company that has a little more than 500
employees and has the following statistics:

* 29 have been accused of spousal abuse
* 7 have been arrested for fraud
* 19 have been accused of writing bad cheques
* 117 have directly or indirectly bankrupted at least 2 businesses
* 3 have done time for assault
* 71 cannot get a credit card due to bad credit
* 14 have been arrested on drug-related charges
* 8 have been arrested for shoplifting
* 21 are currently defendants in lawsuits
* 84 have been arrested for drunk driving in the last year
..
Can you guess which organization this is?
..
Give up yet?
..
It's the 535 members of the United States Congress. The same group of
idiots that crank out hundreds of new laws each year designed to keep
the USA in line.

Posted by: nikegurl

i've seen that before (but still glad you posted it for people who haven't)

my only thought...i think they need to go in and update the numbers periodically. some must be going up

Posted by: rrgg

THIS IS SHOCKING! Only 84 DUI!

Posted by: nikegurl

that's the stat that made me think someone had lost track and needed to update the totals!
