Couple bug Ohio student to hear teacher bullying

COLUMBUS, Ohio (AP) -- A couple raising a 14-year-old developmentally disabled student say they hid a recording device on the girl to prove a teacher and school aide were bullying her, and the audio and subsequent investigations have led to a lawsuit, the aide's resignation and disciplinary action for the teacher.
The girl's mother and the woman's longtime boyfriend said in court documents that they complained about the mental and emotional abuse to school officials in the Miami Trace district, about 30 miles southwest of Columbus, and then secretly recorded instructors' comments for four days last spring after their claims were rebuffed.
In the recording, voices identified as aide Kelly Chaffins and teacher Christie Wilt are heard questioning the girl's weight and how active she is and making derogatory comments about her character and the character of her mother and the boyfriend.
"Are you that damn dumb? Are you that dumb?" Chaffins said. "Oh, my God. You are such a liar. ... You told me you don't know. It's no wonder you don't have friends. No wonder nobody likes you. Because you lie, cheat ... steal."
In another instance, Wilt apparently talks to the girl about the results of a test before evaluating it. "You know what, just keep it," she said. "You failed it. I know it. I don't need your test to grade. You failed it."
In another recording, Chaffins asks the girl if she does chores. When the girl says no, Chaffins responds "Don't you find that a little ridiculous? ... How you gonna do a job? ... You should be embarrassed. I just am in awe. Makes you worthless."
The girl's mother, Kourtney Barcus, and her boyfriend, who helps raise the girl, said in the lawsuit that their concerns about the aide spanned several years before they recorded the audio and that school officials initially rejected their claims. But they were shocked by what they heard on the hours of tape.
"We couldn't know. We didn't know," the boyfriend, Brion Longberry, said Tuesday on NBC's "Today" show.
In comments to the local newspaper, district superintendent Dan Roberts acknowledged this week that there was a problem.
"The persons involved fell short of our mission," Roberts told the Washington Court House Record Herald, which first reported the story. "We're sincerely sorry for that and we will work very hard to never let that happen again. We need to provide proper training and restate our expectations of how we treat children so that this never happens again."
In an email to a social worker in April, Roberts said he had looked into similar complaints from the boyfriend earlier in the year and found that the girl was lying. "It came to a point where I had to remind the man that his continued false accusations were bordering on harassment and slander," the email says.
The girl, now a freshman, was moved from the middle school to the high school ahead of schedule this spring as a result of the situation and is enjoying her new teacher and new environment, but the family remains upset with her previous instructors and how the district handled the situation, said the family's attorneys, Brian Garvine and Daniel Mordarski.
"To say this stuff to any 14-year-old girl would be just awful," Mordarski said. "To say it to a girl that really doesn't have the capacity to fend for herself or to speak up or to really fight back is - it's just heartbreaking."
A $300,000 settlement was reached in a lawsuit filed this year by the girl's family against the school district, Wilt and Chaffins, the attorneys said.
The lawsuit alleged verbal and emotional abuse and inappropriate comments by the aide and the teacher, as well as failure by school officials to report suspected child abuse. It also said the instructors put the girl on a treadmill if they were not satisfied with her work.
The school has said the treadmill is used strategically to help students focus.
Chaffins resigned, and the State Board of Education on Tuesday accepted her decision to give up her educational aide permit "based upon her inappropriate comments to students," according to documents from the board. That prohibits Chaffins from getting another job as an Ohio teacher's aide.
After a confidential investigation, the board decided to suspend Wilt's license as an intervention specialist for one year because of "conduct unbecoming to the teaching profession." Under an agreement with the board, Wilt can avoid that suspension if she remains in good standing with the district and completes eight hours of training focused on bullying awareness and reporting child abuse.
Roberts, the superintendent, told the Record Herald that Wilt has not taught this school year because she's on family medical leave.
Messages left Tuesday for Roberts, Chaffins, Wilt and their attorneys weren't returned.
The Fayette County prosecutor's office reviewed the case but didn't pursue criminal charges.

wow. huge surprise. i was told by a child protective worker that teachers get away with abusing students "every day". that it costs more to prosecute them than it is deemed worth because they are too well protected. your ONLY recourse is to hire a private attorney. the cops in my town were disgusted with the school and DA... they said the biggest problem is "no one has the balls to do anything about it" meaning the law. if they hadn't recorded it it'd still be happening.

No shit. If a tenured teacher were to be caught sodomizing a kid in the hallway, he'd probably be put on paid leave pending an "investigation". The teachers' unions are destroying the education system in the US&A. If nothing else, tenure needs to be abolished. The fact that this "teacher's" punishment is 8 hours of "sensitivity" training, in lieu of one year of suspension is a joke. If he worked in the private sector and talked to a co-worker that way, he'd be cleaning out his desk the same day. Criminal charges should have been pursued regardless of what it cost to prosecute them. These teachers are sadistic fucks to say these kind of things to kids.

Im sure a lot of parents are going to send their kids to school now with hidden recording devices. But not before coaching their kids to instigate and provoke a response from some frustrated, underpaid teacher.
On the flipside, it's not a bad way to balance out the tenure system. Teachers may be moar likely to watch their behavior, knowing this could happen to them.

There are a few teachers that I had in Junior High that were serious assholes, one hit me over the head with a book. That crazy jew bitch got what she had coming though, they fired her ass shortly after I left though I never found out why.![]()

My GF just started teaching and I think I might read something like this about her in the paper.
But seriously teachers shouldn't be that verbally abusive with a student whether they have disabilities or not. How could you even do that to a struggling kid? I was a teachers aid for a special ed phys ed class. That was one of the best things I ever did. Those kids were so happy and it made their day. I have a soft spot for helping developmentally challenged kids.

I remember my first year of Kindergarten none of the Teachers knew I was dyslexic. I have vivid memories of having to stay in class during recess and my teacher yelling at me while I tried to write a b and I swore I was doing it except it was d. She would call me stupid, retarded insist I was doing it on purpose, "you are so smart at everything else why can't you just do it this way!". She'd squeeze my hand as hard as she could with the pencil between my fingers and write b b b b b b b b and then tell me to do it and I would write d.... Finally my parents learned about her and the principal figured out I was dyslexic. Teachers didn't know much about it back then I imagine many kids got treated like that....

More parents should visit their child's classroom -- during class -- to meet the teacher face to face and also to see how their child behaves.
This would give the teacher a connection to the student's family as well as give the parent a perspective on the challenges a teacher faces when maintaining an orderly classroom.
Tenure seems like a myth. I'm a tenured teacher yet all it would take to show me the door would be three Unsatisfactory evaluations. Any principal can simply mark an employee as Unsatisfactory and it's aloha. Tenure doesn't count for much any longer, imo.

Frustrated? At times. Underpaid? I've worked many $20K per year jobs, so I'm very grateful for the salary I currently command. Today, actually, marks my ninth year with the school district as a full-time employee.
But I'm equally grateful to be an elementary school art teacher. There's no better job.

And people definitely underestimate the mental abilities of first graders. Children today are very aware of their surroundings and comments being made around them and about them.


I was watching Dr Drew last night and they had some of the transcript from the conversations. personally I do not call talking about a persons weight to be abusive but a teacher surely should not be making belittling comments of that nature to a child and especially not one with special needs.

For seven years, the Los Angeles Unified School District has paid Matthew Kim a teaching salary of up to $68,000 per year, plus benefits.
His job is to do nothing.
Every school day, Kim's shift begins at 7:50 a.m., with 30 minutes for lunch, and ends when the bell at his old campus rings at 3:20 p.m. He is to take off all breaks, school vacations and holidays, per a district agreement with the teacher's union. At no time is he to be given any work by the district or show up at school.
He has never missed a paycheck.
In the jargon of the school district, Kim is being "housed" while his fitness to teach is under review. A special education teacher, he was removed from Grant High School in Van Nuys and assigned to a district office in 2002 after the school board voted to fire him for allegedly harassing teenage students and colleagues. In the meantime, the district has spent more than $2 million on him in salary and legal costs.
Last week, Kim was ordered to continue this daily routine at home. District officials said the offices for "housed" employees were becoming too crowded.
About 160 teachers and other staff sit idly in buildings scattered around the sprawling district, waiting for allegations of misconduct to be resolved.
The housed are accused, among other things, of sexual contact with students, harassment, theft or drug possession. Nearly all are being paid. All told, they collect about $10 million in salaries per year -- even as the district is contemplating widespread layoffs of teachers because of a financial shortfall.
Most cases take months to adjudicate, but some take years.

3 teachers knocked my son out and locked him in the dark when he was 8 yrs old and all of 60 pounds. not a fucking thing happened to them. fuck your teachers union. above the law much? a ton of lawyers refused to take the case because teachers are too well protected and have bottomless resources for defense. he came home in clinical shock, covered in bruises, confused, and scared to tell me he made a joke about god.

you really should. and it should be public, loud, and ugly. it hurt my son as much to be called a liar and to have people want him to just go on at school as if nothing had happened. he knew he was horribly violated and he was forced to try and deal with it seeming to be okay with everyone but mom. it is my sincere hope that he someday finds his voice and lets those cunts have it for what they did to him and it echoes through the community that allowed it. the police even appealed to the DA to act on it but he declined. i might have some facebook mud to sling of my own come to think of it.

I worked with two Autistic women in their 50s and it was a very pleasurable experience. I never witnessed either of them having a single unkind moment. For the most part Norma hardly ever said a word then one day she decided she didn't want to join the group on our outing so I said I'd sit in the van with her. Well she talked up a storm. Some of the elderly people I worked with were cantankerous with each other, the special needs people never were. Have to be pretty void inside to take advantage of or abuse such vulnerable people.
