<<Under the federal Uniformed Services Employment and Re-employment Rights Act and Arizona state law, an employer may not terminate an employee who is called to active duty.
    >>

What part of this did Pep Boys misinterpret? Not only is it a State law but also Federal.

Pep Boys can/will be sued but I don't think the wronged soldier can collect punitive damages. The best he can hope for is the wages he lost due to being fired. Even after he collects that his credit report will still be FUQED.

No no, dear comrade, I could not allow that to happen, for you see...
"There is a correlation between time and decision making that can be illustrated throughout a chain of events that occur in a human journey. One would make a decision that would carve into his/her life one increment at a time, creating more obstacles, yet interestingly enough allowing more opportunities at the same time. Now your initial approach of a calculated risk decision making is merely nothing but a reflection to that one increment that just carved in. They say a philosopher might label such an action as “Fate” or “Destiny” But are they? That is truly a wonder for all ages. But one would then ask, what are we left with? That is not vague, irrational, or what an organizational behaviorist would term as “Cybernetic Paradigm” .
Another would jump an yell “Attitude” yes that is all we are left with, which really is another product of the all time Human dilemma of Nature versus Nurture. It is almost like the Supreme Being is saying “ Here you go, one more puzzle for you, but be careful not to spend your life time attempting to comprehend it, or even define it.” But sadly enough, we all do, in one way or another we do. Could in be a reflection of our emotional nature, I mean we cry when we seek a loved one, we cry when we find a loved one, and we cry when we lose a loved one."

and in closing, allow me to say that nothing is smart about bombs.
    Sincerely,
DaMayor (Director of the "Slam MJ till they drop" foundation)

isn't this being a bit harsh? It was only one pep boys, not the corporation. I mean yeah I might not choose that particular pep boys to ever go to but i wasn't planning on it anyway. I have a feeling that if it were hooters where this happened it wouldn't change your opinion so much

    Here's PepBoys response:
    http://www.pepboys.com/about/media/c...pr_031803.html

"Unfortunately, recent press reports have drawn attention to a former Pep Boys employee who has filed a lawsuit alleging termination due to military obligations. While it is not the Company's practice to comment on ongoing litigation and personnel matters, this employee's termination, on June 27, 2002, was unrelated to his military reserve status and solely related to other factors dating back to the summer of 2001."

About halfway through the article is a section titled "Other complaints". There's been a total of three in Arizona and one in Pennsylvania. No, not a gigantic number but one to cast a very dark shadow on the entire corporation.

i think the corporation defending it is BS though. I think that's gotta hurt them more so than claiming up to it.

but there's bound to be several cases of this throughout america besides the pep boys chain. I don't know why Mr. Pep would send out a memo not to allow active duty members to fight for the country. And I'm sure these head members are more aware of the laws than some jo shmo manager
