    Not yet, but they're working on it. The problem is that the law will be at the federal level, this suit is at the state level.

    Sorry, albubby but there is. Federal Rule of Civil Procedure 11 requires that a lawsuit not be frivilous.

    Most states have Rule 11 counterparts.

    OK, my bad. I was pigeon-holing my response because I was thinking about the proposed legislation that will protect the gun industry from frivious law suits.

    So, since Rule 11 already exists, how do suits like this one make it to court?

    Oreo's lawyer's will file a motion to dismiss the action for failure to state a claim, and it will most certainly accompany it will a Rule 11 motion (assuming in federal court) for sanctions.

    Nothing can prevent someone from filing a frivilous lawsuit.

    This goes back to part of my response to Butterfly, if Rule 11 only applies to federal courts then what's to stop assholes like this from filing the same frivilous lawsuits in state courts? (I'm pretty sure the article said it WAS filed in a state court. )
