Angry my NEW car has a transmission problem

I bought a 2004 Subaru Outback wagon in December. It's 6 cylinder, 3.0 liter, 212hp. 7600 miles on the car, and there is what appears to be some kind of transmission problem. DAMMIT!

The automatic transmission is not shifting smoothly. When I accelerate from a stop, the car "kicks" when it shifts from 1st to 2nd, causing the car to jerk. When it shifts from 2nd to 3rd, the RPM's shoot up to about 4500 before settling back down. When I am cruising along on the highway and step on the gas to accelerate quickly, the transmission again "kicks" and it feels like the transmission is going to just fall out from under the car.

I brought the car to the dealer Saturday, and they could not find the problem, although they agree something is wrong. I have to drop it off again Thursday so they can spend all day looking at it. Damn, yo. I never had a problem like this with the two Acuras I owned.

Well hopefully the DEALER can fix the problem, but I'd be interested to hear Supertech's theory on this. I posted this on a Subaru discussion board and got no feedback.

I have an 80 mile round trip commute every day, and I take a lot of weekend trips to Vermont for skiing. I don't mind it.

With that much driving, why didn't you get a WRX? Would be a lot more fun.

Very unusual for a car with low mileage to have any sort of problems.So when they do it will be covered under manufacture warranty.
The problem you are having seems to be a computer controled shift problem or it could be a defective tranny.Regardless I would be upset and would ask for a different car,Because who knows what else could be wrong with it.
After you get this problem fixed and if you do keep this car I would take it to a independent shop.A Suburu speacilist would be best.(not the dealer) to have it looked over before your warranty is up.

It's definitely covered under warranty. Subaru's warranty is
very extensive, covering even normal wear and tear. Thanks for the feedback. I honestly can not see a dealer forking over a new car if they fix the problem.

Ahem, automatic = shyt.

If its a lemon though they have to fix it, I will never own or drive an automatic. I think if it has 2 or 3 major problems (forget) its under the lemon law and they must replace the car if you push.

I knew someone would say that about auto transmissions. I think it's just personal preference.

Wow, I've owned three Subarus and haven't had a single problem. I'm surprised one is giving you a hard time. Maybe it's not the car.

Yeah, so my car needs a new transmission. 8,000 miles on the fucking car and it needs a new transmission.

Because the car is brand new, the dealer needs to get a transmision off the factory assembly line. Great, I estimate this problem will finally get fixed in about two more months.
