I can't say for sure what I'd do, I've never actually been in that situation. I think it would depend on how the cops acted during and after the raid. If they came in like storm troopers and absolutely demolished the place you can bet your ass I'd be hauling them into court. If they admitted their mistake and appologized I'd probably leave it at that.

The search was done within the parameters of the law and they had probable cause. Sure it sucks, but it's not like anyone was harmed or anything. I do think an apology from the police force would be in order.

BTW, I only read the summary, not the 11 page report.

I don't see how monitoring someone's garbage habits and electricity bill could lead to probable cause. I could see if an informant gave them info saying "these folks tried to sell me weed or something." It seems as though an agent probably saw the utility bills at best or maybe saw them take trash out in the morning.

I read the papers and it seems as though the basis of this entire investigation was from an Agent tip, Excessive power usage, they drive a minivan, and that the family took their trash out in the am rather than putting it out the night before. The guy wanted to fly over the house and use an infrared flight to scope it out, but I guess the weather was bad and they couldn't fly. I guess they didn't want to wait for the weather to clear up given the fact that the family could have packed the minivan up with all the weed, or kids, and fled the country or possibly go to DisenyLand for a winter vacation.

The best part is on the last page there is a "Property Taken: form that has "No Prperty Taken" written on it.

Dg, how would they have gotten the electricity records? Also, I have no idea what the Kw usage is for where I live, but our bill is over $300 a month on a constant basis and we have no weed growing that I am aware of. I can smell that rubbish too, I hate that stuff.

On the first page it says he got a tip and then they monitoried the electric usage. So who knows what the tip was? I'm not sure if you need a warrant for electrical records? It may be public info. Either way they can get it.

Holy high kWh Batman, I just looked at my electric bill. Last year July I used 2868 kWh and I am almost never below 1434 kWh per month. I far exceed those people, I better be on the lookout. That is absolutely rediculous that they would do that.

A very good friend of mine is a Las Vegas police officer in the drug controll unit. Just last week his team busted a 3,700 square foot house that had NOTHING but marijuana plants growing in it. The police were able to get a search warrant for the property based on elevated eletricity usage. True, there were other factors that lead to the police being suspicious of the house but it was the electricty usage that was the final key. Mistakes happen, but I'd rather err on the side of safety.

Ahhhhhh, I got ya Dg. Honestly, I don't care if someone uses drugs or not just as long as they don't get behind the wheel of a car, which often happens. We all see the crackdown on Steroids and how it is a retarded law, but alas, it is still al law.

Ya know, I just realized that my bedroom window ha a black sheet over it and our power is through the roof. By the criteria that has been mentioned, I could be raided. I have no pot in my room. I guess my only saving grace is that we NEVER take out the trash.

If they were smart they would use a guerilla grid-tie solar system to offset the utility or an off-grid system like they do on the Big Island here in Hawaii, but alas we are talking about people who risk there freedom for a plant that grows wild in some other countries. If they enjoy it that much why not just move there?
