what is the statute of limitations on an arrest warrant issued for a class B felony (aggravated battery or aggravated assault) ?
does it depend on what state the offense occured in ?
TIA

Not positive but I don't think felony warrants expire. Are you talking Nevada?
Did this involve a weapon? I assume it did.

I think statute of limitations only applies to filing of charges, once the charges have been filed and a warrant issued it's locked in.

Most assaults in NC are misdemeanors. The only felony's are assualt with deadly weapon with intent to kill or AWDW inflicting serious injury. These are class H and F. I think it would stay good until they caught the guy. They may return it un served, but if anyone ever checks if you get stopped or arrested, it will show up and they will serve it then.Originally Posted by LAM

Do you have one?? If so, the best thing to do would be call the county in which it was issued and they will probably work out a deal with you. You will have to go back and answer charges, but it will be better in the long run. You might could just show up in court and not spend time in jail................

Most lawyers will give you a free chat if ya tell them straight up front the deal. Try a few ... but also remember the first guy to file is gonna win. You might oughta look at beating him to the punch if you think he will file on you. Same as divorce ... the first one to file normally comes out the victor. His attempt to file on you will be considered bogus and retalitory. Again Lam hit the legal referal services in his town so you know where you stand. If you do get hit with a case you can always plea it down to a non-felony assault. Been there done that 3 times.
Some warrants do expire. Check this out because this crap changes over time. I out ran a federal warrant in the '70s. To late for them so it got squashed by my lawyer.

well the thing is he definetly had to go to the hospital so I'm sure the cops interviewed him. but he doesn't know me so I have that going for me.Originally Posted by DFINEST
fortunately I'm friends with the DA of that county in PA. I may have one of my state trooper buddies run a check on me next week and see if anything comes up...

Im an idiot on this type of stuff..... but if I beat the shit outta a guy, and he still didnt know who I was, I wouldnt be worried about anything.Originally Posted by LAM

small town...so I might be OK, but as I was putting the beat down on him I was telling him why it was happening. so that he would know that is wasn't just a random act of violence...Originally Posted by du510

But at the same time, he would be embarassed to tell the police that. That would even get him in more trouble than it would get you in. No?Originally Posted by LAM
I would think it more sensible to accept a beatdown than to open a huge can of worms. He probably made something up in the hospital to tell the cops.
I'd have a lawyer check into it. If you know the guys name, the lawyer should be able to dig up some info, if he filed charges. I, too, doubt he did - but better to find out now than a few years from now.
