    Angry Well Damn!

    On the way home this afternoon after picking my children up, I was involved in a wreck. It was on a 4 lane road with a paved median. I was in the left hand lane in my direction, and a truck in the opposite two lanes(he was on the inside) pulled around and tried to pass a car in pouring down rain. His tires were slick on the back so you can guess what happened. He spun out and came across all three lanes into my lane. I saw him coming and almost missed him but I t-boned his ass. I turned slightly left before impact because he was still traveling across my lane to the inside. My right side (fender and wheel, including rotor) was completly torn off. Both airbags deployed. Matthew was in the right front seat with me. Maddison was in the backseat behind Matt. Thankfully, none of us were hurt. Matt has red marks across his chest where the seat belt held him and a slight bump on his nose and a burn on his chin where the airbag got him. The guy driving the truck had a bloody nose and cuts. I'm not sure what all was wrong with him. But a guy behind him, about my age stopped and told me he had been driving way to fast. Since my caddilac was a 98 model, I feel sure it is going to be totalled. So Now I get to spend tomorrow getting a wreck report and going to my insurance company to see if I can get a rental car and to see if I can get his insurance to give me enough to buy something comparible to what I had. I know it's going to be a fight. I will probably get my lawyer to handle it for me. Asshole was showing his ass in the rain and comes across 3 lanes to hit me. Much less endangering the lives of my kids. He's going to pay!!!

    How did the guy react? Whos fault did the cops say it was? What was the outcome there?

    I already knew what happened before I talked to him. He said he tried to miss another car. Yeah right. I just said don't worry and walked off. Luckily, the police officer was a guy that used to work for the sheriff's dept and I knew him. He told me the report would be cut and dry as far as who's fault it was. That's obvious anyway. But his licensce were expired. So he got a ticket. He did have insurance though. You know a car can be replaced, but my kids cannot. There is no amount of money that I could get to ever put them in that situation. Him being reckless and dangerous is why I'm so mad.

    Of course, thats apparent and understood.

    Its good though, that youre not at fault. Ive found it amazing how easy it is to twist the situation and share the blame.

    scary. i'm glad everyone is okay. watch the kids for signs of being nervous in the car for a bit. we were in an accident with Tess in the car n she said her tummy hurt in the car for a while after. she was 5 at the time. some bozo ran a stop sign coming up a huge hill n totalled our car. we weren't badly hurt but still got a tidy little settlement for bumps n bruises. i was pregnant for Ty n the back pain was unbearable sometimes. chiropractors rock.

    You know... All too often we take for granted all those days we drive without incident. I drive every day trying to remain aware of my actions and surroundings. Just goes to show you that no matter how careful you try to be you can never be sure about the other idiots who lurk in the traffic. Glad you kept your wits about you.

    Good to hear that everyone is ok. I was involved in an accident on sunday, some idiot merged into my lane without looking. My drivers side is all thrashed, I have to jump in dukes of hazzard style now. But like you said, cars can be replaced, people can't.

    Matt woke up this morning throwing up twice. What scares me is that is a sign of internal injury. So I have a doc appt. for him at 8:40am. I'll try to post a pic of what is left of my front end later today.
    Wit, I saw him spin out and saw him coming and I was slowing down, but the angle at which he was coming I couldn't do a thing. If I went right he would have got me worse. I just stood on the brake to see how far he was coming and at the last minute I tried to turn left and I t-boned him. All the damage was on the right front fender.(On Matts side)

    Sounds like you made the right call in t-boning him. Would rather you do it to him than he to you... good choice on the doctor DG, who knows if its just nerves, bleeding, or what, but either way you cant go wrong with that.

    btw, did you get that guy to wait around and give his statement that the guy was speeding and driving like an ass? Or at least get his tag?

    I am GLAD no one got hurt!!!!

    As for "totaling" watch out for your insurance company. Make SURE your attorney says it's "ok" FIRST. DO NOTHING without your attorney saying it is ok - PERIOD!!!!

    I was involved in an accident a few years ago with my truck. Me and a friend of mine were going down a rural paved road to a small town to get some chicken for a late lunch around 2:30 pm on a really nice fall day (around 65 degrees and total sun! Perfect day!).

    On a real sharp s-curve that goes down, around, over a creek and up on the exit- side, a white car came screaming at me at at LEAST 55 MPH on two wheels (on the his driver side) on a 15 MPH curve headed down the hill towards me and my Buddy. It all went real fast. I heard the screeching first and turned my steering wheel sharply to the right and immediately towards the guardrail at my right while going uphill in my standard shift pickup truck but it was not enough - the guy hit me real hard starting to hit me at the driver's side door (gas tank - brand new - right under my feet) and tore the entire back-side just beyond the cab on the driver's side completely off completely bending back the rear solid steel step bumper, kept going down the hill into the curve, hit the guardrail and ran along it about 200 feet or so, went over the bridge, and up the next hill and down the road about 5 miles to where we found out he lived.

    A person that lived at the top of the hill heard the accident and ran over and asked what happened. I told him and he got into his vehicle and chased after him (at at least 90 MPH he told the Highway Patrol) and caught up with him at the house he lived.

    The guy was brought back to the accident scene. He tried to get me to just take his name and address and then leave. I said "no, the highway patrol is coming". So when the patrol came they talked with him. He had been drinking (you could smell it on him - one of those "professional drinkers" that can seem to be able to do anything), he was driving without a liscense, driving under suspension, no automobile insurance, left of center, excessive speed, left the scene of the accident, and was driving a car he did not have permission to drive - the owner had killed himself with a shotgun at his girlfriend's house (the house 5 miles down from the accident) two months before over the breakup in the back yard so the car this guy was driving belonged to a dead man. The girlfriend, when interviewed by the patrol, "said" she was "asleep on the couch and did not know her present boyfriend took the car" - she "did not give him permisssion to drive it".

    Come to find out that when someone is killed or dies auto insurance is usually immediately cancelled so the vehicle this guy was driving had no insurance. I had total coverage and always do. It took my insurance company (which I no longer insure with) 6 months to get me any money at all and they wanted to total my vehicle - I told them NO WAY!! And I repaired it with NEW parts myself at MY expense.

    This guy NEVER paid ONE CENT, he did not have a job. I went to the county corner to ask about the owner of the car and how he REALLY died, I went to Victims of Crime (they told me no "crime had been committed since no one was hurt and the driver of the other vehicle was not cited for DUI" - well what the HELL, he was driving under suspension, no liscence, drinking while driving, left of center, left the scene of the accident, no insurance, did not have persmission to drive the car in the first place and NO "Crime"??!!!!!!)

    I went to a lawyer who substitutes as a judge from time to time and he told me that there was nothing I could do since this guy has no money. This guy was ONLY cited for "left of center" and nothing more. And got off completely.

    And to top it all off, I ran into this guy one week later at the store I was going to to buy chicken for lunch buying MORE beer and wine. He was in the check-out at the same store buying MORE. So I proceeded to call him out IN THE STORE and as verbally as I could so EVERYONE WOULD KNOW about him and was HOPING the police would come - but nothing (go figure!!!).

    I got the impression when I went to Victims of Crime, the Sheriff, the County Corner, etc. that this guy was KNOWN to them and this was all being covered up for some reason. The Highway Patrol told me to call them the next day for more information and that they wanted to speak to me. So I called the next day and the Patrolman I was supposed to talk to was NOT there - I was told by a lieutant that he "was on vacation" - I asked "how long" - he said "for awhile" - I asked him why I was supposed to call and then no one was willing to speak to me about the accident. He said basically nothing. SOMEONE was covering up for somone.

    Lastly, MY insurance company tried to jack up DOUBLE MY insurance rates the next year when rewewal time came about. I told them NO WAY the accident was NOT in ANY WAY my fault. They said "yea that what they all say" - I told them to check THEIR RECORDS and they came back and said "yes you are right" and recinded the increase - but the NEXT YEAR tried the same thing!!! And ended up recinding that increase.

    What's the odds of this happening? To anyone and someone getting completely off. I did absolutely NOTHING wrong and got "fucked" all around.

    At least me and my Buddy did not get hurt at all but it was REAL CLOSE - we could have both been killed and burned to death trapped in my vehicle and this guy just drove off and down the road without stopping.

    Just be damn glad no one got hurt and get a DAMN GOOD LAWYER.

    I'll post a story of mine but i wasn't involved nor was it a car accident but it was funny.

    Last summer, my sister and i were going to the gym. It takes about 10 minutes to get there and we were almost there as we drove up to the lights and were about to take a left on the highway. Well, on the right is a very small gas station and the parking area is bad. This guy who had a big truck backed up and hit a small car really hard in the back. I saw the whole thing happened and i was like "ohh shiiitt". Then the guy was shocked and looked around to see if anybody saw. He looked at me and waited for us to go then he followed behind us and sped off the other way as fast as he can. lol, it was hilarious how he wanted to avoid being caught and not having to pay for the damage. I knew he got behind us so we couldnt see his license plate. Not that i would write it down anyways but it was hilarious.

    Everytime i watch the news, there's always an accident and the driver always drives off as a hit-n-run. Why do people do that? Seriously, if you hit a kid..why would they continue to drive off? Is it because they are afraid? You would get in more trouble leaving the scene and getting caught later than facing the consequences if you stopped.

    Glad to hear your kids are okay. Hope the little guy is just nervous stomach.

    Take that sucker for everything you can get, especially if he was making excuses for driving recklessly. Maybe next time he'll wait and not pass people when the roads are wet and save some poor child's life. Good thing you T-Boned him - if he broadsided you I can only imagine what might have happened.

    Turned out Matt is ok. Everything is ok. He has some bad sinus drainage and allergies that was causing him to be sick. An antibotic and an allergy medicine and he should be fine in a couple days.
    Now the bad news. I got the copy of the police report and went to my insurance office. My agent called his insurance and after about 15 minutes of exchanging information, turns out this guy policy was cancelled feb. 28, 05. So he had no insurance. Now I can't get a rental. I went to my lawyer's office that is handling my divorce. Her husband handles traffic and civil stuff. I have a 3pm meeting with him.
    The guy that hit me is only 25 so I doubt he has anything for me to sue to get. I will probably not get a penny from him and I'm out a car! My insurance will cover my car under uninsured motorists, but I probably won't get what the car is worth. I am going to sue for everything possible if I can.
    Just my luck. I swear, can't much more go wrong for me! I'll update later after I see what the lawyer says.
    BTW, he did get charged with careless and wreckless driving and failure to reduce speed to avoid an accident. The report said he was accelerating rapidly and lost control.

    NT, looks like I'm going to have to take you up on that $50! LMAO!
    After talking to my lawyer, IHO, it is worthless to try to sue. The kid is 25 and does not have anything. The truck he hit me with was a 1985 chevy truck (s10), primered and half painted and probably only worth several hundred bucks. He said after I paid him $1000 to sue him, I would not get anything and basically loose my money. He said the best thing to do is talk to the DA once the C&R is scheduled for district court and get them to add restitution to me as part of the settlement. Then again, if he doesn't have anything, I won't get anything. But what I am hoping is the judge will put him in jail until he pays me, but I doubt that will ever happen. So I'm not at fault in the wreck, and I'm out of a pretty nice commuter car and nothing happens to him. I checked the tax records after talking to the DA and there is nothing in his name except for two vehicles and one is totalled and he has not payed taxes on either. Like I said, my luck...........SOL!!!

    Too bad vengeance is still illegal. That kind of situation always gives me thoughts of burning down his house or something like that. He's taken from you and need to have something taken from him in return.

    He'll probably go ahead doing the exact same thing. Justice sucks.
