    Im going to get flamed for this but..

    Im gonna say he shouldnt be charged with murder. Perhaps if he had pointed it at her/threatened her, my opinion would be different.. In this case its her own fault, IMO; I think everybody needs to have a little more mental fortitude than that. Shes a victim of her environment.

    I shared this with a Mexican friend of mine and I like his response....

    The guy should not be charged with murder. Anyone knows that a Mexican with a gun is not threat. Now... if he had a KNIFE...

    I think it would be closer to manslaughter than murder, but I dont even think it would be that bad. Closer to assault almost (assault varies VERY widley).
