    Traffic Court - any advice?

    Got a ticket last week for doing 51km/h in a 40km/h zone. It was during rush hour and I was following the flow of traffic downhill and they pulled me over. Car in front of me and car behind doing the same speed. I was so surprised I got pulled over I actually asked the cop if he was serious.

    Anyway, yes I was speeding and I don't care about the fine (it's only $40). What I do care about is that it will show up as another conviction on my record (even though it's no points) and that will screw me for my insurance rates (I checked - they will almost double costing me over $1000). Therefore I'm fighting it. I've never done this before because it's never been necessary. Is it possible to plead guilty and pay the fine and not get a conviction? Or if I pay the fine I'm admitting I'm guilty, correct? Are there any tactics I can use in court to get the case dismissed? I'm obviously hoping the cop doesn't show up and it's automatically dismissed but that's not likely. Anyone with experience please let me know - or should I go to one of those places where they fight stuff like this for you?

    You actually got a ticket for 11km/hr over the speed limit

    What a fucker.

    If you use one of the companies that fight tickets for you, the cost will be around $300. what are there 3 options.

    1) plead guilty
    2) plead guilty with explanaiton
    3) Plead innocent.

    I would fight it 11km/hr is a joke, especially if it would end up costing me $1000. Alot of Judges are reasonable.

    Maybe meet with one of the Agencies that fights tickets, get there opinion. They know alot of the cops, and will be able to tell you whether this cop is likely to show up or not. Some cops are ticket hounds and will make every appearance.

    Not sure about your area but here in Florida we have many lawyers that specialize in only tickets. I use a company called the ticket clinic. A friend of a friend started the company. They only charge $69-$99 depending on the violation. They guarantee no points and withheld adjudication. I've used them three times and they're just a advertised. The best thing is you do nothing. You don't even have to show in court.

    Deny all charges, claim faulty calibration in the speed detection equipment even of your own speedometer maybe they were each 5.5km out of synch, if that doesn't work question the sobriety and sanity of the cop, question the sanity and sobriety of the... the baliff, the court clerk hell even the judge if you have to go that far eventually you'll find someone crazy or drunk on the job and it'll get thrown out on a technicality.

    The best thing to do is hire a lawyer and let him get it pleaded down to somthing like improper equipment or prayer for judgement. It will cost you a little money but less than insurance in the long run.

    My father pleaded faulty equipment and ended up paying alot more than the ticket, but no points or anything.

    I say go into court shitfaced. Stare at the officer with alook of death the whole time, never look at the judge. Then, when the judge says he will hold you in contempt, look to him and say, "I hold myself in contempt. I should have iced this pig the second he pulled me over for this bullshit offense. Now, instead, I am going to have to spend some time finding out where he lives, go there, kick the shit out of his son, fuck his wife and daughter, and then kick his dog on the way out." Should get you off the hook.
    If sense were common, everyone would have it.

    And.... accept responsability for your actions. Admit to the judge you fucked up, thank the officer, pay the fine, and ask for court supervision. Completing supervision without another ticket means your insurance company wont find out about this one.

    Or you can do what Manlicon says and the court will step on you. You think a traffic court judge hasnt seen, or heard, every scam imaginable? We calibrate those speed guns daily and you have no chance with that "out".

    And if that Judge feels you are lieing he'll fuck you good. To Lie after vowing to tell the truth is exactly the kind of advice that has screwed this country up. Go ahead and see how far it gets you and afterwards send Manlicon a bill.....................Uncle Rich..............

    This is Canada, so I don't think we can do that here but that's a great idea. Another one people have given me is to delay delay delay the court date - apparently I can push it off for months. I'm not planning on getting into court and trying to lie because there's no way I could, I'd rather find a way to get the ticket waived or dismissed somehow.

    Is there any chance if I was totally honest about my situation a judge might just waive it? I have no idea how lenient judges are - basically I would be rolling the dice and if one was having a bad day or decided to screw me that's it, right? Would the sympathy card about my insurance rates work?

    Usually you might could get it continued 1 time but after that I would not count on.

    I dont know about Canada. But I have written, and testified over, like a zillion tickets. I dont write many of them anymore but everyone I did had it coming. Your best bet is at the scene. Many times a working person has said to me, "Officer I know I fucked up but I have money problems and a family, can you please give me a break"? And I did! Whay shouldnt I?

    Now? After all Ive been thu? Im just not going to sit there and tag working people hurrying to work.

    But the problem is, even when a citizen has been a gentleman, I still take an oath to testify truthfully. And 99 out of 100 times the person ticketed is found guilty. I suggest you do what I tell you, tell the truth and ask respectfully for consideration. With or without a lawyer.

    Yes I could tell you how to weasel out of it. But you cant expect me to give you advice about how to lie or slither. Especially since you sound like a total gentleman. By taking responsability you will impress the court.

    By all means get a lawyer and/or ask for a continuance. Its your right! There have been many times I have missed traffic court because I was tied up in a more important procedure and everyone got off scott free.
