Question on prenuptial agreements

Im getting hitched in the spring next year and i dont know realy anything about what a prenuptial agreement is, other than what you see on TV.

Do I (we) need one?
I plan on staying togeather forever but you never know...

What I have.
I own 25% of a 1/2 million dollar house in san diego.
I own 25% of a maybe $100,000 gross year skate shop.
I own a 1997 VW GTI

Thats pretty much it.

What she has.
Shes a brand new 2006 car paid off
Trust fund. Her grandfather owned a apartment complex, all the profit from the complex is divided between the 7 grand kids every month and when the youngest grand kid turns 35 (he is 17 now) the apartments will be sold and the amount will be divided among the 7 grand kids.

So yeah we dont have much, but we both are very ambitus. She is going all the way for her PHD (full scholership) and im getting my bachlors deg.

Should i get a pre-nup?

Ive know her about a 1 and 1/2 years.

She will be very offended, but my dads been married 5 times and ive seen him just loose everything including his mind to many times.

But since we both dont have much and will probably get alot of stuff over the next few years while being married, im not sure if a pre-nup dose anything for things you get while being married, i guess i dont know shit.

I just want to do better than my dad has.

She lives off her scholership and trust fund and goes to school full time.

I make about $24,000 a year, but will be getting a job before we get married paying $34-39,000.

Here's the correct answer...

If you are thinking you need a prenup,
just take the next step and not get married...

Marriage is just a sham for churches and bridal shops
to get rich anyway...

Buy some cheap bandsor necklaces, and have a commitment ceremony
dont involve religion or the legal system!?!?

What business is it of theirs anyway???

And if you are younger than 35, you don't know what youre getting into!

Trust me dude, I think its a sham too, but SHE wants it, she is a great girl and takes great care of me and i want to give her whatever she wants, That includes getting married.

23 is way too young to get married, if she really loved you she would not push you to marry her.....get the prenup but better yet do not get married till you are 30+.

Ok, we have gone off the topic a bit.
This isnt a thread about should i get married or how you feel about it.

My question is this:
Is there a point in me going through the shit of getting a pre-nup (hurting her feelings and such) when we both have so little?

I don't know much about CA law, but I wouldn't think you need a pre-nup. Those are for people with substantial assets. You are doing fine for yourself, but not to the level of need asset protection like that.

Community property states are tricky, so you might want to talk to a CA attorney.
