My wife was a District Attorney so I learned how the law works, or sometimes does not work.
1) The police arrest the person and gather the evidence on why
they think a crime has been committed.
2) This evidence then goes to the DA's office and they decide if

Anybody but Gibson, Kennedy, or any other politician / celebrity would have been arrested and charged. These tools get off, and it is bullshit.

FYI... if the officer witnessed the crime, its the officer's discretion wether to charge or not. He dosen't need a warrant. And, if he feels he needs the advise of the prosecutor, he can just call one. DUIs are usually not handled that way... unless it's an accident where the drunk has a head or life threatening injury. In that case a warrant is done for the blood, and the subject will be arrested later. Otherwise, the offender would be charged based on the results intoxalizer, urine, or blood test. The offender can chose the method of testing, your best bet is the intoxalizer (your attorney can attack the service records and accuracy of the machine). Refuse the test and its an automatic 1 year suspension of license, violation of implied consent. The officer will charge subject based on his probable cause for a motor vehicle stop, probable cause for a field sobriety test, and the results of the test. Something else to keep in mind, if you test under the legal limit, chances are you will still be charged, but with the lesser Driving While Impared. And if the, officer writes a good report, a DUI or DWI is usually an easy conviction.Originally Posted by milliman
