    Is it illegal to..

    Is it illegal to walk around lets say in a mall while you are high? The 2 people I have asked have both said that it isn't illegal to be in public while you are high. I don't know though. Does anyone know?

    I think you can be arrested for public intoxication, but it is highly unlikely that you will.

    Here is the public intoxiacation statute of Alabama and I think it is the same in most states.

    "A person commits an offense if the person appears in a public place while intoxicated to the degree that the person may endanger the person or another."


    So simply walking around the mall while being high, acting silly, and laughing like a moron is probably not committing a crime. Being a drug user, I try to be informed as mucas possible about the laws, but DG or some of the other law enforcement people on this site can give a better answer.

    Exactly no such thing as a breathalizer test for pot in the US. They could take blood but that requires a subpoena if i'm not mistaken.

    The charge for drugs is possession not use. I have told cops plenty of times that i'm high but have no pot on me and nothing has ever happened.

    I've been pulled over while high and the cop knew i was high but i just denied it, knowing there is no way to for him to test me. He made me take the stupid sobriety test, i walked a straight line and said my abc's. He had absolutely no grounds on which to even ticket me. I simply told him that i do smoke pot but i'm not high at the moment. He was in a jam and let me go but didn't let me get into the midtown tunnel saying, "I know you're high you little bastard, you're not going through my tunnel." It was actually fun, lol.

    You guys forget that the cops can arrest you for public intoxication without proving that you have anything in your system. There is a good chance you can beat the charge in court, but they still can arrest you if they want to. All they have to say is they believed you were intoxicated to the point of hurting yourself or someone else and bam! you spend the night in the drunk tank. at least that is how it works in Alabama.

    Where are the law enforcement people? Camaro or DG knows.

    Anyway, I do not know of any laws that would make it illegal to be stoned anywhere. I have yet to find one to arrest anyone with. All the laws that deal with drugs in WI, say possession, delivery, or maufacturing.

    Public intoxication would be one that you could try, but you would have to prove that they where under the influence, and the influence of what.

    Now driving under the infulence of a drug/intoxicant is a different story. If you are stopped you can be arrested and your blood can be taken incident to arrest for the purpose of preserving evidence. You are not allowed to operate a motor vehicle with any detectible amount of a restricted controlled substance in your blood. However there would need to be a reason for me to beleive that you have a detectable amount in your blood.

    In europe they have tests they can use out in the field that do not require blood.

    I've been on acid and stoned out of my mind while walking by cops and it had to be evident I was wasted yet in Hawaii they really don't care. I've even had a cop come up and bump the back of my legs with his Cushman as I was doing my Kung-Fu at high noon stroll down a sidewalk...

    I think the key phrase is "a dange to yourself or others". I know plenty of people who can be high as fuck on all manner of things and still not be any sort of a danger - they just say some really funny shit.

    Is it illegal? Maybe not. Can you get arrested? You can get arrested for sneezing. At the end of the day, even if you get off it will cost you a ton of money, and probably have something on your record that a background check will turn up, even if it isn't a conviction.

    Bottom line, if you aren't acting high, you shouldn't have a problem. If you are too high to act normal, you shouldn't have gone in public.

    yes, it's public intoxication, but it would be hard do get busted for being high, drunk would be easy and they could test you on the spot with a breathalyser.
