SACRAMENTO (KABC) -- A proposal has been made to try to relieve California's overcrowded prisons, but not everyone is pleased with the idea.
The clock is ticking as settlement talks over California's overcrowded prison system are down to the last month. Court-appointed referee Elwood Lui released a proposal to trim the state's inmate population by nearly 40,000 over the next four years, ultimately capping the number at 132,500.
"It makes it safer for everyone who's inside the prison system, both the inmates, the staff members -- the correctional custody staff," said Matt Gray from Taxpayers for Improving Public Safety. "Prison simply cannot function in a safe manner right now with all of the overcrowding."
But tough-on-crime Republicans are worried about safety for everyone else outside prison. Lui wants to send the 40,000 lower risk state inmates to county jails, which are already jam-packed, and releasing their inmates early, just as LA County and other locals have done.
Critics say this proposed settlement sets the stage for even more early releases.
"Folks in the neighborhoods are going to know you don't spend time in county jail, and so what that does is it just gives individuals licenses to create crime and havoc in our communities," said state Senator George Runner, R-Lancaster.
With Republicans in no way ready to agree to a prison cap, the lawsuits brought on by inmates over the crowding issue will likely go to trial - at great taxpayer expense - on Nov. 17.
While in Oakland Monday, Gov. Arnold Schwarzenegger, R-California said he'd rather see both sides work it out.
"The federal court is right to complain about that and to go to trial if we don't settle it. So I hope that both of the parties come together and settle it," said Gov. Schwarzenegger.

Seriously though, its pretty fucking ridiculous that one of the most liberal, tax-loving states won't properly fund its criminal justice system. Criminal justice is one of the only things that is undeniably the responsibility of any government. Yet I've read before that government employees in California can recieve free sex change operations under their health coverage. I'm glad they have got their priorities straight.

I think that the phrase "prison overcrowding" is a contradiction in terms. Shouldn't a prison be crowded? Uncomfortable? Miserable? What the hell do I care about a con? Did I put him there? Did I, or the system let him down, causing him to break the law? Heck no.

I think they need to cowboy up and do their time. No T.V., no gym no nothing...just pay the price and stop whining.

Kill some of them. Problem solved. When the prison gets overcrowded again, kill more.

Actually, just skip the entire jail process and kill all first degree murderers, child molesters, and rapist outside the courthouse after the trail conviction.

They're releasing people because the state of California has no fuckin money. They can't afford to keep paying for food, medicals bills, guards, etc...

I wouldn't mind if they did that but you have to remember that a lot of innocent people are wrongly convicted as well. If you were falsely accused of killing someone and were to be executed, would you want a shot at an appeal or should they just go ahead and kill you?

Let the Prisoners run the jails themselves like the one in Bolivia, San Pedro Prison. Make the prisoners responsible for manufacturing products necessary to the rest of society. Let the white collar inmates do the executive decision making and the others do the production with opportunities to advance. If they don't make the money their prison won't be as nice and food will be scarce. A self sustainable prison makes a lot of since just keep the same number of Guards but post them outside only, never inside.

Lets outsource our prisons to countries like Africa. It will stimulate their economies, provide relief for our crowded jail systems, and blunt the danger of escapes causing harm to our society.

If only we could a cost-effective way of transporting them out of here.
