L.A. City Council votes to ban medical marijuana shops

The city has fumbled with its medical marijuana laws for years, trying to provide safe and affordable access to the drug for legitimate patients while addressing worries by neighborhood groups that streets were being overrun by dispensaries and pot users.

LOS ANGELES - Unable to rein in hundreds of medical pot shops that blossomed around the nation's second-biggest metropolis, the Los Angeles City Council banned them Tuesday until the state's highest court weighs in.

The 14-0 vote drew an angry, profanity-laced response from some medical marijuana advocates who attended the council meeting.

Mayor Antonio Villaraigosa was prepared to sign the ordinance, according to his spokeswoman, Vicki Curry. The storefront ban would then go into effect after 30 days.

In the interim, letters will be sent to as many as 900 dispensaries advising them of the ban.

The city has fumbled with its medical marijuana laws for years, trying to provide safe and affordable access to the drug for legitimate patients while addressing worries by neighborhood groups that streets were being overrun by dispensaries and pot users.

"Relief is on the way," said Councilman Jose Huizar, who introduced the so-called "gentle ban."

Many cities have struggled with medical marijuana ordinances, but none has had a bigger problem than Los Angeles, where pot shops have proliferated. At one point, the city ordered closure of the shops ? a process that failed amid lawsuits and conflicting rulings by appellate courts.

This time around, the city has a stronger case if faced with lawsuits by pot shop owners, city officials said. A recent appellate court ruling seems to support the new ordinance that refers to a marijuana collective as three or fewer people.

The ban also allows hospices and home health agencies to provide medical pot.

"A judge could file an injunction but we think that is unlikely," said Jane Usher, a special assistant city attorney.

The ban comes during a confusing time for Californians ? despite voter approval in 1996 for medicinal use of marijuana with a doctor's recommendation. The state Supreme Court has decided to clarify marijuana's hazy legal status by addressing whether local governments can ban medical marijuana clinics. But a hearing has yet to be set by the high court.

Meanwhile, U.S. authorities have cracked down on pot clinics around the state, saying such operations remain illegal under federal law.

Los Angeles passed an ordinance two years ago that was supposed to shutter hundreds of pot dispensaries while capping the number in operation at 70. But a set of legal challenges against the city by collectives and last month's expiration of the ordinance thanks to a sundowner clause led to another surge of pot shops. City officials said 762 collectives have registered with the city and as many as 200 more could exist.

"We need to start with a clean slate," Councilman Mitchell Englander said before the vote. "Los Angeles has experimented with marijuana and has failed."

However, the ban could be temporary for some dispensaries. A motion made by Councilman Paul Koretz called for city staff to draft an ordinance that would allow for about 180 pot shops to be reopened that were in business before a moratorium was enacted several years ago. That motion isn't expected to be considered for several months.

After the vote Tuesday, some medical marijuana advocates shouted expletives, while others questioned where they could get the drug in the future.
"You don't care about people!" yelled one person.

At least 178 California cities from Calistoga to Camarillo and 20 counties already have banned retail pot shops, according to the medical marijuana advocacy group Americans for Safe Access.

Reflecting the murky language of the state's medical marijuana laws, a handful of dispensaries have successfully challenged such local prohibitions in court along with laws that merely sought to regulate dispensaries.

Most recently, an appeals court in Southern California struck down Los Angeles County's 2-year-old ban on dispensaries, ruling that state law allows cooperatives and collectives to grow, store and distribute pot. But in a separate case, an appeals court said federal law pre-empts local municipalities from allowing pot clinics.
The hearing came a day after a priest, drug counselors and others decried crime and other social problems they say surround neighborhood marijuana dispensaries.
Among those who spoke at that gathering was a woman who complained about having to push her baby's stroller through clouds of marijuana smoke near dispensaries in her East Hollywood neighborhood.

Daniel Sosa, a medical marijuana advocate, told council members during the hearing it's fruitless to approve a ban that won't have any merit, and will likely lead to more lawsuits.

"If you can't enforce it, why are you going to pass something?" Sosa asked the council.

Exactly, the big companies arent making money like their greedy asses feel they should be. This isnt just with medical marijuana tho, with everything!

I will play the opposite on this one... Keep in mind this is not what I believe, but just some thing to stir the pot...

Why should MJ be any different for medical use then any other prescription? Why should you need a card? With any other drug all you need is a doctors prescription. There is no limit of what people can purchase or use. Shouldn't a real doctor determine the amount that each person needs and then a real pharmacy prescribe the medication? What would be the difference between getting an oxy card and being able to buy unlimited amounts of oxy?

---my real opinion---

The dispensaries are just making money off of people and are loop hole drug dealers. If MJ stays as a medical drug, doctors should have to prescribe it and insurance should pay for it. Why should some one with an actual illness have to pay for there MJ it should be covered by their insurance. ( or is it? am I wrong). I know a few local, well now shut down dispensaries and they were all drug dealers that found an easier way to make more money. Any one that uses MJ religiously is not using it for medical purposes (the word anyone is a figure of speech) they are using it for recreational purposes (nothing wrong with that). The word medical MJ to me is just thrown around WAY to much. My cousin a navy vet with PTSD who NEVER left Lemoore, Ca and claims he is all fucked up is a liar to get a card. A 20 year old with sleeping problems that does not wake up until noon every day does not have a medical reason. An actual VET who has seen death and closes his eyes and see blood.. Valid... Some one with major back pain from sports or injury yes valid reason.

My biggest complaint is people take advantage of the system. Dispensaries fucked things up by not running things properly and people realize 80% (made up %) of people lied to get the card. Now before I get negged or put on blast... These are the people who are fucking it up for the real medical users. All in all MJ should be legalized sold cheap and taxed. Actual patients should get there MJ for free.

Half this shit probably doesnt make sense what I wrote, but half the shit I say never does. Just wanted to toss another perspective. I don't smoke, but I am for MJ and support every one medically and recreationally.

You can't buy pot, but when big pharma comes up with a synthetic version it will be readily available with all of it's nasty side effects. I have come to the conclusion that there are no people that truly want to limit the size of .gov, most want to limit it in some ways and grossly expand it in others. In a perfect world government would do nothing, in the world we are in they do nothing and somehow manage to fuck everything up at the same time. A perfect example of this is the way we deal with food. We subsidize shitty food to make it cheap so that people can afford it. Then these people get diabetes, heart disease, and cancer from the food they subsidize and then we end up subsidizing their health care and eventual dependence on pharmaceuticals. So we pay $9 billion on the front end to make shitty food cheap, then we spend $190 billion taking care of fat shits who shovel it in to their mouths ad libitum.

MJ should be just as easy to buy as tobacco and food. Energy drinks are more hazardous to us then MJ. most every thing is safe in moderation its idiots that abuse things that ruin it for us. I.E prework outs, cough medicine, and ect. Then you get fags that will shoot and fight over MJ. Make it hold all most no value and you will find crime drop.

Our gov't has to much power and no matter what happens even with a dream president its going to take 10+ years to fix this country. Only way to make it happen is a damn revolution...

See sig vvvvv

Yup, they closed all the MMJ dispensaries where I live. You can only get delivary service now, but that's next to end.

The people voted to pass this law, because we know there are medical purposes to MJ. Now it's only right to make that shit available...Do you really want to revert us back to prohibition so we have to purchase our meds on the black market...WTF!

Of course you do, just like the stuff that brings us all together here.

To keep your jails filled with non violent criminals. That's why I don't fly on your airplanes, cause I am not a criminal and wont be treated as such.

But you need us to fight your phuquin wars, don't you!

why did congress need a constitutional amendment to ban alcohol, but now a days they just pass laws to ban drugs?

I think because they knew they were taking away freedoms and the only way to do it lawfully was a constitutional amendment.

a perfect example of the "free markets" at work....capitalism as it is practiced in the US is a zero-sum game among many other things....

"Los Angeles has experimented with marijuana and has failed."

If they'd inhaled they'd have had a much better experience.

they are just trying to shut down all the unregulated shops the popped up after the last ban. The first 100 shops most likely will stay because they are in the right locations according to the law and pay a fair amount of tax revenue to the city.

As you folks know, alcohol causes a hell of a lot more problems.

I have not problem with pot. I know lots of people who smoke it here in Vietnam and back in the US and of course its used all over the world.

In Vietnam the weed is all natural. No hydroponic additives. Just a natural herb. A lot weaker than the stuff from the Pacific Northwest that I felt was too strong.

I probably had not smoke MJ for 20 years and Actually, I now take a puff or too a couple of times per year in Vietnam. It's so weak and natural that it gives you a slight 'good feeling' that wears off quickly.

I still prefer a Gin & Tonic.

if you live here you know that it is out of control, these shops are literally on everycorner. If you are on Van Nuys blvd or sepulveda they are hundreds of shops. We really dont need that many.
