If you're referring to down syndrome, no. I can't think of one example of someone with down syndrome or mental retardation committing a crime warranting the death penalty, so I can't imagine it being a big issue. They'd probably need to be the focus of some type of medical study since it is probably a rare occurrence.

goandykid is right, you're question is too vague. Assuming that the retardation is severe, the answer would be no. Murder, in the legal sense, assumes a certain level or premeditation. I also assumes an understanding of consequences. Both of which a mentally retarded person would lack.
