SHELBYVILLE, Ky. -- A Kentucky man suing a doctor for amputating his penis testified Monday that he wanted to flee the hospital when he learned part of the organ had been removed.

Former truck driver Phillip Seaton testified during his civil trial against Dr. John Patterson that the doctor came into his room after the 2007 surgery that was supposed to have been a circumcision. Patterson's attorney said during opening arguments that he had no choice but to remove the tip of Seaton's penis because it was riddled with deadly penile cancer.

Seaton recalled Patterson telling him, "The bad news is you have cancer. The good news is I had to cut some of your penis off."

Seaton said he then went into the restroom.

"I pulled the dressing down, and I didn't see nothing," Seaton said under questioning by his attorney, Kevin George. "Then I came out of the restroom and I said, `I'm getting the hell out of this damn hospital.'"

Seaton, 64, and his wife, Deborah, are seeking unspecified damages for "loss of service, love and affection."

Deborah Seaton covered her face and cried when George asked her husband how he has felt since the surgery.

"It's all been a dream," Phillip Seaton replied. "I ain't woke up yet."

He said he's a "bad case."

"I didn't have no say in it," he testified. "I wasn't told what had to be done. It was just done."

Patterson's attorney, Clay Robinson, said during opening arguments in Shelby County Circuit Court that the doctor discovered deadly penile cancer during the surgery, and that Seaton had initialed a document authorizing treatment in unforeseen circumstances.

George had said during opening statements that the document had been read to him because Seaton cannot read.

Seaton testified that Patterson had told him he would cut foreskin during the circumcision and described it as "more or less in and out." He said he had even joked with the doctor about the procedure.

Robinson said during opening arguments that Patterson was faced with "a dreaded dilemma" during surgery upon discovering the cancer, which he said was invasive and could only be treated by surgical removal. He told jurors his client removed only the tip of Seaton's penis because it was so riddled with cancer it "had the appearance of rotten cauliflower."

"Mr. Seaton is here today, able to be in this courtroom ... because John Patterson saved his life," Robinson said.

Jurors were shown graphic images.

George presented four photographs of Seaton's groin saying, "You can see there's nothing there." He also told jurors that Seaton "doesn't feel like a man" anymore.

Robinson offered up a photograph of the cancerous tip of a penis - not Seaton's.

Seaton's brother, David Seaton, later testified that Phillip Seaton has been depressed and angry since the surgery.

"The spark is gone out of his life. He used to be such a happy person," David Seaton testified.

No, Patterson just decided to whack that bad boy off right then and there.

Needless to day, Seaton was a little bummed to wake up from surgery to find he'd received a full buzz instead of the trim he'd asked for. And he was especially bummed to discover he only had stage one cancer, which is considered relatively treatable. But either through arrogance or incompetence -- you really weren't using that thing, were you? -- Patterson decided to give him a volume discount.

Jewish Hospital and the anesthesiologist reached a settlement last week, realizing that most juries won't look benevolently on unauthorized penis theft. Yet Patterson plans to battle on. He was supposed to head to trial yesterday, but that was delayed over questions of whether he could get a fair trial with all the publicity surrounding the case.
 
c'mon people. does anyone here really think the doctor screwed up here? it's not like the doctor wanted to go into a routine circumcision and said "i'm bored, maybe ill take a bit more off than normal this time for kicks"

edit: after reading it was stage 1 cancer he may have given the guy some time to prepare for the inevitable, and gone back to take the rest at a later date.

my post was pretty clear. this doesn't sound like a malicious doctor who went in to ruin this guys life. the doctor didn't give him cancer. he saw a deadly invasive cancer whose only treatment is surgical, and he did as he was trained to do to save a life.

with it being stage one he could have brought him out of his circumcision surgery. talked to him and his wife and told him he has to go back into surgery in a week to remove the cancer or he is going to die painfully. either way the guy gets his dick cut.

Yes, but maybe the outcome wouldnt of been so dramatic. By the description of it, it sounds like he was clipped at the base.

There are just some things where you definitely get a second opinion.

Still remember (traumatized just by the THOUGHT) an article in the local paper of a young man -- before his wedding day as I recall -- who went to his local surgeon/doctor about an undescended testicle.

Simple procedure, the doctor was to snip a bit and I guess the testicle drops? His hand slipped and the man woke up missing his penis.

The article stated something like, "it was unreported if the wedding took place."

True, but I'd say that "in a week" would have been a very important period of time for the 64-year-old. Like a final farewell to a very good friend. lol

either way his only choice is going to be massive reconstruction surgery. no matter where it was clipped. If they can turn a vagina into a penis they have to be able to give this guy something

It states pretty clearly that surgical removal was the only treatment for this cancer. And truthfully I believe it. I doubt chemo, or radiation are normal in penile cancers such as this.

On a side note. he was in for getting the turkey neck cut off. seems a bit late, but thats what he wanted gone

I'm pretty sure i don't have penile cancer and my penis head doesn't look anything like cauliflower

Despite the alleged seriousness of Seaton's penile cancer, experts contacted by ABCNews.com said that the doctor needed consent from the patient before surgically removing his sex organ.
"I think the doctor made a big mistake, and will not win the case," said Dr. David Crawford, a professor of surgery at the University of Colorado Health Sciences Center.
Partial penectomy, or a partial removal of the penis, Mohs surgery, a precise surgery used to remove several types of skin cancer, laser and radiation therapies were all options when treating penile cancer, said Crawford.
Because the surgeon had said the cancer was so severe, Robinson told the courtroom that Patterson could treat it only by surgically removing the organ.
Nevertheless, "a surgical consent is needed to do this," said Dr. Glenn Bubley, associate professor of medicine at Harvard Medical School. "This is the standard of care. There would be no reason to breach standard of care in this case."
 
they will give the guy something... a huge chunk of the dr's pocket money. i'd give the guy the dr's house, car, eldest son.... he didn't even bother to confer with the man's wife before amputating his penis. if it looked like cauliflower why were tests not done before the procedure? as far as i can tell the dr has no proof it did look like that.

it's no different than finding a cancer in a woman's breast and denying her the choice to have a lumpectomy or have her entire breast removed. this so called dr acted way outside the scope of acceptable.

This.

Friend told me that her doctor advised a mastectomy. She wasn't having it. Chose a new doctor and selected a different treatment option. She saved her breast and survived the cancer. Not sure what stage, how advanced, or whatever, but she definitely didn't accept that first doctor's recommendation.
 
I have a question.. what guy would want to get a circumcision at the age of 64? Like, guys are paranoid about anything near that area, and this dumbass allowed a knife? This story is very fishy to me. If anything, I would be calling it a setup that the "patient" made to screw this doctor over. How could the dude not know there was something wrong growing on his dick?

He should have been consulted before anything other than what he was in for was to take place. "Seaton had initialed a document authorizing treatment in unforeseen circumstances." This is binding, is it not?


But, I will be stamping this as "American Greed" for the time being; sorry neighbours.
