It's not kinda rape. It's date rape, and you're going to have a really hard proving its consentual sex, if she's stone drunk and you're sober, and she takes you to court afterwards, with DNA evidence.

I think if a girl is conscious she's fair game, cause no matter how drunk I am I never use that as a crutch to justify foolish decisions, although alcohol usually just leads me to fist fights. my input... About the whole date rape commenting, the judge wont know if you were drunk or not nor will the girl who is drunk.

I dont see what the big deal is with this. He said if you showed up to a party late and she was all over you. She isnt passed out on a couch somewhere, no roofies were installed, etc.
