Religion is simply a persons philosophy which they share with many others in varied degrees from extreme to liberal, if their morals are that they shouldn't be ogled by other men and they search high and low to find a decent place to workout, sign a contract based on a promise that they will have a seperate time to workout man-free the gym is required to live up to that promise.

As I mentioned in your other thread I think you may have a case that you don't have to agree to the new gyms contract because of the massive changes they made to the original gym.

But maniclion, you know that nothing in the US works on promise. Buyer beware is the name of the game. If you do not research what you are buying, or services you are purchasing, then you are liable for the expenses you incur. The women were foolish to sign a lifetime membership in the first place. I can't imagine anyone ever buying a lifetime membership to anything. Nobody can predict the next year, much less the rest of your life.
That would be like us signing a lifetime cell phone contract.

I completely respect their wishes to workout alone, but their wishes are not figured into the legal equation. Only their signature on a binding document, which the owners of the gym report saying nothing about exclusive women's only days, matters.

Morally, the gym should give the women's money back so they can find a different gym that they would be happy at.
Legally, the gym should tell the women to go fuck themselves and learn to read a contract.

That is small claims court, and signed contracts carry more weight than any other kind of agreement. Plus, the gym would never admit that they told the women that there would be women's only days.

So far, about 200 Muslim women with Fitness USA memberships have signed a petition asking the chain to return to gender-specific days for the entire gym or to put up a divider so men and women can't see each other while working out.

200 women obviously were promised before that they would have segregation and then the chain added a new section and made it open to all genders without regard to blocking the view of it's old section to cater to the segregated half. That many verbal promises will hold weight, and I am sure that in the end the gym will put up a partition.

I bet if you got enough signatures complaining about the changes at your gym you could make some changes yourself.

The legal eagles here will attest to the heart of the matter:
ALL verbal agreements are legally binding. The trouble is that without proof they fall apart in a courtroom. I somehow suspect that 200 women will constitute the "burden of proof" needed to get the petition's points worked out.

UHhhhhh peeps ... notice a complete lack of mention of punitive damages? If this had been 200 American Christian women you can bet your favorite statue of Jesus there woulda been a law suit complete with Gloria Allred screaming about damages for having been deprived of their rights and being forced to work out in such a mentally anguishing environment. The eminent class action suit would have had no regard for balance or fairness, and the dollar amount would have been immense.

These girls signed a petition which only asked for the gender segregation agreed upon by both sides to be worked out somehow and even provided the suggestion of an inexpensive way to resolve the issue. No money or BS ... just a simple "Hey this is neither fair nor allowed for us so please fix this" mentality. If this philosophy of dispute resolution were to become popular our courtrooms would actually have time to hear cases involving violent crimes within one month of the violation and get the damned thing done inside of six tops.
