No doubt for the next week I'm going to burst out laughing at random times at the thought of you approaching the bench with your little gloves on. The thought actually makes me want to laugh and puke at the same time.
 
Back to Martha... she did the crime, she should pay some sort of time. I'd say that a fine and some extra stuff would be enough. Like mentioned earlier, I dont really find it necessary to convict someone 5x longer for taking a couple hundred grand than someone who commits murder.

A person can earn more money, you're only getting one go at the life... so murder is by far the more atrocious.

What is so stupid is that whe would have gotten off alot easier had she not been involved in obstructing justice and lying to the government. I think if you knowingly lie, you should get your ass nailed...period.

I do not like MS, but how you can look at this situation and say that she deserves jail time is beyond me. Give me a break, she is not getting special treatment b/c she is a celebrity, she is getting the shaft b/c she is a celebrity.

You cannot be serious.

She COMMITED a crime. That's how I can say she deserves jail time. It's simple. There are rules in this society, and punishments for breaking them. She broke them.

If she's getting the shaft because she is a celebrity, then it's about friggin time. She SHOULD be made an example of. While I can see your point, let's look at the facts.

1. She's a former stock broker and she's on the board of the NY Stock Exchange. She knows the rules about this stuff, and lucky for her, the judge threw that charge out.

2. She LIED about what she had done. Not once, but repeatedly.

3. She conspired to cover it up. She's not an idiot. I'm sure she understood what the laws are. Hell, they even tell you before you speak, what your rights are. She didn't have to tell them anything. She decided to lie, and got caught in it.

Bottom line is: She did this to herself. She did it to save money that was nothing more than a drop in the bucket compared to what she is/was worth.

You are correct though. This wouldn't have happen to me. Why? I wouldn't have commited the crime. It was senseless and stupid, esp since she could have avoided the whole thing by NOT doing what she did.

I'm sure she want's people to feel sorry for her, and I'm sure many do (such as you). Me, I have a healthy respect for the law and feel that those that break it deserve what they get.
 
Martha Stewart was convicted Friday of trying to cover up conduct that isn't a crime. She was convicted of being greedy and of being cheap. She was convicted of having a bad memory and of being arrogant. She was convicted of acting scared and using terrible judgment. She was stupid and today the jury made her a convict.

For these transgressions - the government calls them obstructing justice and making false statements and the jury agreed
I am no lawyer but she was convicted despite the lack of direct evidence against her. She was convicted despite the fact that the circumstantial evidence was capable of creating competing inferences and therefore reasonable doubt. For example, just because Stewart was told about Waksal's interest in selling his shares on December 27, 2001 doesn't mean that she and Bacanovic didn't have a pre-existed plan to sell them. And just because the stories that Stewart and Bacanovic gave investigators didn't exactly mesh on all levels doesn't mean they were lying. The jury convicted the defendants of a conspiracy that in substance and in process never really clicked.


Does all this mean that Stewart is innocent? No.

I hate Martha Stewart , but let's face it, she is going to jail because she wasn't honest with investigators about a telephone call that any investor would love to get and that many investors do get every day in this country. It is interesting to me that a successful woman of a huge empire, rather than the myriads of men who have done the very same thing through the ages, was thrown out like some kind of witch hunt. No bloodshed was committed. The world isn't safer today than it was yesterday.The only difference between her and them is that the feds decided to make an example of her. It worked. From where I sit, the jury felt she should be punished and made an example of for what powerful coorporate men have been doing for ages. Not saying this was a mysoginistic jury, they truley believed what she did was wrong and deserves punishment. I am just commenting on it from a social anthropological level.

In other words, Pepper and I don't think she doesn;t deserve it, but our justice system is not consistent and judicious in the way it delegates punishment. That is the problem. Future coorporate scammers are just going to learn how to select their juries better and come up with a better defense strategy. She will in no way dissuade such future behavior.

So answer this, why indict Martha and not Ken Lay ? (former chairman of Enron). Afterall, he dissimated a whole industry and ruined countless lives when they lost their retirment fund. I believe he still got to keep his golden parachute.

I totally agree with this statement. People think she got the shaft I do not. She is a schemer, liar and cheat. this we know without a doubt. The court just prooved it. She deserves jail and that's the bottom line. She was found guilty and that is that.

I don't know why but why did the other guy involved commit suicide? And how did Hillary Clinton skate on through too? She is a female right? She wasn't indicted and she had some shadey dealing with them from what I believe. The way you think,,, Hillary should have been the scape goat and should be doing 20 to life right now. But the court system isn't as corrupt as you claim it to be.

She was not indicted for white collar crime...they never proved she was guilty of insider trading, so this whole issue about white collar crime is mute. This is unlike Mike Milken. Instead, they had to find a legal loophole (obstruction of justice) to get her.

I don't like Hillary or Bill either, and I believe both should be in jail.

The whole point is Ken Lay was free, a former vice president of Enron, can't remember his name, gets only one year in jail (She will likely get at least that or more) for a crime that is miniscule compared to these other coorporate giants. Don't let your hatred of her personality (which I hate as well) cloud your judgement.

I think you are confusing me defending her as male bashing, I am only pointing out the selective prosecution that Pepper pointed out is occuring, however, in this case, I bought up the fact that she is a woman. As an egalitarian.... equal punishment for equal crime no matter what the sex or race...this is not what is happening.

She deserves her punishment, but it sure looks fishy when worst offenders get a slap in the hand. My observations are objective and rational, not because I am a woman defending a woman. I will post links of such similar opinions written by men.

You need to bone up on your reading comprehension skills but I am in no way defending Martha or making her a martyr. She is guilty , but the law, and society (which the jury represents) is biased, no doubt about that.

Bandaid women laid out some excellent points, if you don't agree with them come back with some thought out answers not some bashing about her social anthropological ideas.

Ok guys and bandaid,, I apologize. I was under the influence of M1T when posting and very tired. NO excuse and your all correct. I did attack her post and took some of what she said out of context. Again I appologize to Bandaid for my rudeness afterall,, she is a mountain biker and we should get along.
 
No offense man but I see you appologize for your attitude a lot, I dont think it has anything to do with M1T. It sure didn't influence my behavior at all.
 
I hear that Mudge but it certainly influenced mine. I've been really fuqing moody and run down to the point I had to stop taking it after only 2 weeks. I even PMed Prince for help with this.
as for my appologizing,, I've said it many times that I feel strongly about certain things and speak my mind very bluntly. I just can't see how anyone can debate this topic at all. She was guilt of a crime and she is being punished. It has nothing to do with someone elses case since they all have their very own unique circumstances.
