July 19 2013 Florida Carry has filed a federal complaint alleging deprivation of civil rights under color of law with the United States District Court for the Middle District of Florida over an incident which was captured on dashcam video, which subsequently went viral on the internet.
In July of 2009, Citrus County resident Joel Smith and his wife were detained at a traffic stop for non-criminal traffic code violation. During the stop, Mr. Smith exited his vehicle to speak with Citrus County deputy Andy Cox, who asked Mr. Smith for proof of insurance for the vehicle. Mr. Smith turned with his back toward the officer and leaned into the vehicle to retrieve the document at which time his lawfully carried and holstered firearm peeked out from under his shirt.
Upon seeing the tip of Smith?s holster, Deputy Cox immediately launched into an unwarranted verbal assault on Mr. Smith, first asking why he was carrying a firearm. Within seconds, the officer drew his own firearm and pointed it at the befuddled Mr. Smith, threatening to shoot him ?in the (expletive deleted) back? if he didn?t immediately put his hands on the vehicle. Mr. Smith offered no resistance, complying fully with the officer?s orders, and informing the officer that he was a lawfully licensed concealed carrier. Ignoring Mr. Smith?s statement, Deputy Cox continued shouting at Mr. Smith, ordering him face down on the ground and cuffing him. Mr. Smith was arrested and charged with open carry of a firearm, a misdemeanor violation of Florida Statutes, however charges were later dropped. A complaint was filed with the Citrus County Sheriff?s Department against Deputy Cox, however due to a technicality, the complaint was dismissed and no disciplinary action against the deputy was taken.
Florida Carry consulting attorney J. Patrick Buckley III who is also representing Mr. Smith in the case summed up the case:
?Improper law enforcement training coupled with an emotional overreaction is detrimental to the civil rights of Floridians. When a Constitutional officer then delays the resulting internal investigation to permit the untrained officer to walk away without so much as a slap on the wrist, it illustrates a systematic absence of accountability in those we trust to protect us.?

Joining Mr. Smith as plaintiff, Florida Carry is representing its membership and millions of Florida gun owners in the lawsuit. Named as defendants are Deputy Andy Cox, Sergeant Dave Fields, Sheriff Jeffrey Dawsy, and Citrus County. The plaintiffs are represented by the Law Offices of J. Patrick Buckley III, located in Fort Myers, FL.

There is a new anti-gun bill sitting on Capitol Hill, and it doesn?t deal with banning particular models of firearms or even universal background checks.

The Gun Violence Prevention and Safe Communities Act of 2013, was proposed by U.S. Reps. Danny K. Davis, D-Ill., and Bill Pascrell, D-N.J. The bill seeks to raise the tax rate on gun sales from 10% to 20%.
Perhaps even more disturbing is that the bill also seeks to raise the tax rate on ammunition purchases to 50%.
Davis released the following statement in a press release,
Gun violence is a daily reality for America and, in particular, for urban cities like Chicago. The crisis should outrage us all. This legislation is a pro-active approach to reducing gun violence by using proven preventive programs which have been starved for funds until now. As part of a comprehensive, multidimensional strategy to reduce gun violence, this legislation closes major loopholes in tax law and lays out an equitable, long term, sustainable strategy to provide the requisite resources.
The preamble of the bill reads as follows,
To amend the Internal Revenue Code of 1986 to increase the excise tax and special occupational tax in respect of firearms and to increase the transfer tax on any other weapon, and for other purposes.
The bill could mark a change in gun control strategy by anti-gun lawmakers. Courts have ruled several times in favor of an individual right to bear arms recently and gun control seems to be of the lowest priority to average Americans (despite the sketchy poll numbers of that anti-gunners continuously quote).
Knowing they can?t outright ban or limit guns directly the anti-gun lawmakers may take advantage of their ability to tax in order to institute additional gun control.
This bill was introduced in the Republican controlled House of Representatives and most likely won?t be moving anytime soon, but we?ll keep an eye on it all the same.

The taxes won't affect criminals one little bit.

I actually see a couple of things wrong in that video. None of which warranted the treatment of that guy. 1. NEVER EVER get out of the vehicle unless instructed to do so by the cop. 2. DECLARE that you are armed. Don't ever let the cop find out by surprise. I don't know about Florida, but AZ is a declare state. You must tell the cop if you are armed. If you don't you are a fool. Even before AZ was a declare state, the couple of times I was pulled over or stopped at a DUI check point while carrying, I always told the cop. In each occurance the cops just said "Thank you and leave it the holster."

Really those 2 simple rules will keep you from getting in a world of shit. You really don;t know if the cop you are dealing with is on the edge of losing it like any other human.

being black in the US when I do get pulled over which is rarely i always roll down all the windows so they can see clearly into my entire vehicle (have tint on all my vehicles) and tell them if I am carrying or not.
 
Fl is not a declare state but common sense would be to let the officer know that you are carrying so that you don't get some asshole cop like the one above feathers all ruffled. I have been stopped once since I have had a ccp and I handed the officer my permit along with my drivers license and told the officer I was carrying. He thanked me and told me to leave it where it was and not make any sudden moves ran my license and let me go on my way. Most cops in Fl support concealed carry but their are always a few assholes in every group.

Florida is a no duty to inform state.
 
While it may not be required, I still think it's a damn good idea. Surprising cops with guns is very rarely a good idea.

FL may not be a declare state, but really....you should. Or you will end up like the guy in the video eating gravel and spending the afternoon with the county.

I deal with cops a lot. SOme are great people who know thier stuff. Others, mainly the new yong ones don't know thier asses from a hole in the ground when it comes to Constitutional rights. A good number of them really believe they are the judge and jury. As some of the older cops have told me, the standards have been lowered for a number of reasons and the egomaniacs and unrestained are getting into the departments.
 
My step-father was a bondsman/bounty hunter, he carried his gun everywhere. Sometimes you could see it when he sat in a chair at a restaurant, but he always had his hand cuffs clipped to his belt loops so everyone probably assumed he was a cop...

Really? Its the end of the month again and I am seeing the same speed traps you had at the end of May, June and July, but I mustn't base my case on circumstantial evidence...
