so I decided id try to get over my racial prejudice, and I loaned my black "friend" a sum of money in the form of a check because he was in desperate need. 2 months have gone by since the date he agreed to repay me and I have yet to be repaid, and he is no longer responding to my attempts to contact him. I was visibly reluctant to lend him money, and he responded to that reluctance with things like "*sucks air through teeth*, nigga why you ain't trust the black man?". I know I shouldn't be surprised im in this situation because he's black, all my white friends pay me back sooner than the agreed upon time lol. Anyways, since there is a paper trail and an oral contract (I also saved all his texts on my phone talking about the arrangement), do I have a case?

none but I watch law & order, a verbal contract is still binding seems you have proof, depends on amount you'll probably have to go to small claims which will cost you time off work and even if you win there is still the matter of making them pay which still wont happen. your best bet is to hold him down and empty his pockets. or my personal favorite is to damage property till it exceeds the amount owed, like $50 dollars, break cell phone or slash a tire, $300 slash 4 tires or get a jar of pickle juice add some dog shit and shakeit up then pour it inside his car the smell will never come out and he wont be able to sell it

unfortunately I do(law school drop out)... A verbal contract is legally binding. you seem to have some evidence of the contract. good luck getting him to show up. and it usually cost 150 bucks to file the claim

right, if he has anything, and a lein on house or car is only good if they sell it otherwise the lein can stay there forever. and if he doesn't have a job they will set up an affordable payment which may be 5 dollars a month, but if he doesn't pay you'll have to continusly keep going back to court. we all know black peoples highest priority is paying bills, IE child support

yep...as the saying goes "let neither a borrower nor a lender be". personally I give money to girls that are in needs as gifts, guys are on their own they get neither.

people that have money problems from my experience have them for the lifespan. everyone that I know that had money problems when were were in our 20's still have them now that we are nearing our 50's.

Yes! Take it to small claims court you'll win if you have the texts that is a written agreement. You will win. No lawyer needed I have done this several times with my business.

doesnt it depend on the state though? I know CA a verbal contract is binding.

I would say check your state if your really in VA its probably less than in Obamanois I mean Illinois... go through it and get a damn judgment filed on his credit. It will fuck him up in the future. he will not be able to get a loan for anything! and A verbal threat of this with an explination will usually get people to magically find the money that they owe you...

SD even if you get a judgment against him he does not have to pay you and they will not garnish wages, the only thing that happens is it goes on his credit report and he can't get a loan, buy a car get a house, rent a apartment until the judgement is satisfied, after 5 years the judgment expires and you have to pay court costs to renew it, now I am talking Pennsylvania it may be different in other states, the reason I know this is because I went thru it and in the end I said fuck it and took it up the ass like a man-Don't lend money period.

you can file for garnishment in the court and then for execution to get the sheriff to gather the funds for you according to this website im looking at
